It is written to the highest applicable standard across all markets in which BX operates and should be read alongside the applicable Data Processing Addendum where BX acts as a data processor.<\/p><h2 data-path-to-node=\"3\">1. Who We Are<\/h2><p data-path-to-node=\"4\">BX Technologies Limited (&#8220;BX&#8221;, &#8220;we&#8221;, &#8220;our&#8221;, &#8220;us&#8221;) is a company incorporated in England and Wales (Company Number 12545451) whose registered office is at 128 City Road, London, EC1V 2NX, United Kingdom. We develop and operate an AI-powered agricultural intelligence platform used by farming businesses in the United States, New Zealand, Peru, Chile, and the European Union. In respect of the personal data described in this Policy, BX is the data controller \u2014 meaning we determine the purposes and means of processing. Where BX processes personal data on behalf of a customer (for example, data belonging to a farm operator&#8217;s employees), BX acts as a data processor and the customer is the controller. Information We Collect<\/h2><h3 data-path-to-node=\"7\">2.1 Information You Provide Directly<\/h3><p data-path-to-node=\"8\">We collect information you provide when you create an account, subscribe to our platform, use SAM AI, contact us, or fill in any form, including:<\/p><ul data-path-to-node=\"9\"><li><p data-path-to-node=\"9,0,0\">Account information: full name, email address, telephone number, job title, organisation name, billing address, and country.<\/p><\/li><li><p data-path-to-node=\"9,1,0\">Farm and agronomic data: farm names, field names, coordinates, crop types, hectarage, agronomic records, and soil or weather observations you input into the platform.<\/p><\/li><li><p data-path-to-node=\"9,2,0\">Payment information: processed via our payment provider \u2014 BX does not store card numbers or bank account details.<\/p><\/li><li><p data-path-to-node=\"9,3,0\">Communications: messages, support queries, and feedback you send us, including via SAM AI.<\/p><\/li><li><p data-path-to-node=\"9,4,0\">Onboarding information: responses you give during platform onboarding and configuration.<\/p><\/li><\/ul><h3 data-path-to-node=\"10\">2.2 Information Collected Automatically<\/h3><p data-path-to-node=\"11\">When you visit our website or use the BX platform, we automatically collect:<\/p><ul data-path-to-node=\"12\"><li><p data-path-to-node=\"12,0,0\">Usage data: pages visited, features used, buttons clicked, session duration, and navigation paths.<\/p><\/li><li><p data-path-to-node=\"12,1,0\">Device and technical data: IP address, browser type and version, operating system, device identifiers, screen resolution, and referring URLs.<\/p><\/li><li><p data-path-to-node=\"12,2,0\">Log data: server access logs, error logs, and API request logs, including timestamps.<\/p><\/li><li><p data-path-to-node=\"12,3,0\">Geolocation data: general location derived from IP address (not precise GPS location, unless you grant permission for map features).<\/p><\/li><li><p data-path-to-node=\"12,4,0\">Analytics data: website and platform usage metrics (Google Analytics 4), session recordings and heatmaps where you have consented (Hotjar \/ Contentsquare), product analytics (Mixpanel, Contentsquare\/Heap), and event routing via our customer data platform (Segment).<\/p><\/li><\/ul><h3 data-path-to-node=\"13\">2.3 Information From Third Parties<\/h3><p data-path-to-node=\"14\">We may receive information about you from:<\/p><ul data-path-to-node=\"15\"><li><p data-path-to-node=\"15,0,0\">Your employer or the organisation that holds your BX account, when they add you as a named user.<\/p><\/li><li><p data-path-to-node=\"15,1,0\">Public agricultural and weather data sources integrated into the platform, including weather data provided by Visual Crossing (visualcrossing.com).<\/p><\/li><li><p data-path-to-node=\"15,2,0\">Payment and identity verification providers.<\/p><\/li><\/ul><h3>2.4 Information Imported via BX Import Agent<\/h3><p>If you use BX\u2019s Import Agent feature, we may collect and process farm data imported from third-party platforms you authorise, including:<\/p><ul><li>Google Drive \u2014 read-only access, limited to the specific folder you authorise (OAuth scope: drive.readonly, folder-scoped).<\/li><li>Microsoft OneDrive \/ SharePoint \u2014 read-only access, authorised by your organisation\u2019s tenant administrator.<\/li><li>Farm Management System (FMS) platforms \u2014 data imported from connected FMS integrations you enable.<\/li><li>Direct file uploads \u2014 files you upload manually via the Import Agent interface.<\/li><\/ul><p>Any third-party credentials you provide to authorise Import Agent access (such as OAuth tokens) are stored exclusively in Google Cloud Secret Manager \u2014 not in the BX application database \u2014 and are retrieved in memory only during the relevant import job. Credentials are never logged. Import Agent processes data on an ephemeral basis: temporary files are created on isolated container storage and destroyed automatically on job completion. Artificial Intelligence and SAM AI<\/h2><p>EU AI ACT TRANSPARENCY NOTICE (Article 50, Regulation (EU) 2024\/1689)<\/p><p>SAM AI is an AI system deployed by BX Technologies Limited. You have the right to know when you are interacting with an AI system. SAM AI is not a human. Interactions with SAM AI may be used to provide you with agricultural advice, analyse farm data, and surface insights. BX is an AI Deployer under the EU AI Act.<\/p><h3 data-path-to-node=\"22\">4.1 What SAM AI Does<\/h3><p data-path-to-node=\"23\">SAM AI is BX&#8217;s in-platform AI chatbot. It allows users to interact with their farm data using natural language, ask agronomic questions, and receive AI-generated insights. SAM AI is built on the open-source Flowise framework, self-hosted by BX on BX\u2019s own cloud infrastructure in the United States, and uses large language model (LLM) APIs to generate responses.<\/p><p>BX Import Agent is a separate feature that allows you to connect external data sources (Google Drive, OneDrive\/SharePoint, FMS platforms) to import farm data into the BX platform. Import Agent accesses only the specific data you authorise, on a read-only basis. See Section 2.4 for details of data collected via Import Agent, and Section 11 for the security measures applied to imported data.<\/p><h3 data-path-to-node=\"24\">4.2 AI Sub-Processors and Data Handling<\/h3><p data-path-to-node=\"25\">When you use SAM AI, your query and relevant farm context data are processed by the following sub-processors. All SAM AI inference is routed via OpenRouter (our LLM routing layer) which provides account-wide Zero Data Retention (ZDR) endpoint controls. Data Processing Agreements and ZDR confirmations are in place or being finalised with each provider listed below:<\/p><ul data-path-to-node=\"26\"><li><p data-path-to-node=\"26,0,0\">Anthropic (Claude models) \u2014 BX holds a Claude Team subscription for internal use; customer data may be processed indirectly. DPA accepted via Claude.ai team admin settings (25 Feb 2026).<\/p><\/li><li><p data-path-to-node=\"26,1,0\">OpenAI (GPT models) \u2014 SAM AI inference and Data Pipeline, via OpenRouter BYOK (Azure-routed). ZDR confirmed via OpenRouter; DPA accepted (25 Feb 2026).<\/p><\/li><li><p data-path-to-node=\"26,2,0\">Google (Gemini models) \u2014 Vertex AI inference via OpenRouter BYOK; ZDR confirmed for Vertex AI.<\/p><\/li><li><p data-path-to-node=\"26,3,0\">Note: Import Agent and SAM AI context store currently use Google AI Studio (direct API; covered by Google API Terms with embedded SCCs as an interim measure \u2014 migration to Vertex AI within 30 days). See sub-processor table below.<\/p><\/li><\/ul><p data-path-to-node=\"27\">Data passed to LLM providers may include your query text and agronomic context derived from your farm data. Full names, contact details, and payment information are not passed to LLM providers. LLM observability (full traces) is captured by LangSmith; automated browser sessions used for farm data import are handled by Browserbase. See the full Sub-Processor List here for details.<\/p><p><strong>None of your data is used to train the underlying AI models operated by Anthropic, OpenAI, Google, or any other AI service provider used by BX. All SAM AI inference is routed via OpenRouter with account-wide Zero Data Retention (ZDR) controls enabled, and all AI provider training\/logging toggles are disabled. Your farm data and personal data are not used by BX to train any proprietary AI models.<br \/><\/strong><\/p><h3 data-path-to-node=\"29\">4.3 International Transfers for AI Processing<\/h3><p data-path-to-node=\"30\">SAM AI&#8217;s inference engine is hosted in the United States. When EU\/UK data subjects use SAM AI, their data is transferred to the US for processing. This transfer is conducted under EU Standard Contractual Clauses (Module 2: Controller to Processor), supported by a Transfer Impact Assessment (TIA) completed in February 2026. A copy of applicable SCCs is available on request from privacy@bx.tech.<\/p><h3 data-path-to-node=\"31\">4.5 AI Data Notice \u2014 SAM AI<\/h3><p data-path-to-node=\"32\">This section is linked from the SAM AI chat interface and provides a plain-language summary of how your data is handled when you use SAM AI.
